Help pack the courthouse for the case against NYS&W, NYRI and OCIDA!
Why
On Wednesday, Oct 11 at 10 am, attorney Joe Giruzzi will appear before the State Supreme Court to argue his case against NYRI, New York Susquehanna & Western Railroad (NYS&W) and the Oneida County Industrial Development Agency (OCIDA).
Giruzzi is arguing, among other things, that by State law, NYS&W was required to apply to the State Commissioner of Transportation to legally transfer rights-of-way to NYRI and that the city's approval was required as well. NYS&W did neither.
Giruzzi believes that this case has, potentially, a route-wide impact.
He is seeking a permanent injunction from NYS Supreme Court prohibiting NYS&W from siting the power line anywhere on the line.
He is asking the judge to invalidate the entire contract based on omitted and required procedures.
Additionally, he is asking NYRI to disclose a lot of information about the contract with NYS&W, which it has so far refused to do.
A number of points he is making are unprecedented. They could go either way. He feels strongly that an impressive show of local support will have some impact on the judge.
It is possible that the case will be deferred, but it will be valuable if the case is decided promptly in our favor. If it is, Utica will take the results to the PSC and request that NYRI's whole application be dismissed based on invalidity of its claim that it has secured the railroad right of way.
